What this Privacy Policy Covers

This Privacy Policy covers how we treat Personal Data that we gather when you access or use our Services. “Personal Data” means any information that identifies or relates to a particular individual and also includes information referred to as “personally identifiable information” or “personal information” under applicable data privacy laws, rules or regulations. This Privacy Policy does not cover the practices of companies we don’t own or control (such as social media data providers or third-party agencies, organizations or companies).

If you are a resident of the State of California you have certain additional rights which are explained in detail below.

Prohibited Jurisdictions

Face2Social does not offer services to, and expressly prohibits use by, residents of the state of Illinois, the European Union (EU), European Economic Area (EEA), United Kingdom, Canada and Russia. If you are a resident of the EU, EEA, UK, Canada or Russia: DO NOT USE THIS SERVICE. If you have already created an account, you must immediately cease use, unsubscribe, and delete your account.

Face2Social has implemented all technically feasible measures to block data and biometric information that can be reasonably linked with the state of Illinois, EU, EEA, UK, Canada and Russia. We do not knowingly collect, process, or store personal data or biometric information of residents from these jurisdictions. If you believe we have inadvertently collected your personal data and you are a resident of these jurisdictions, please contact us via delete my information form with verification of your residency, and we will promptly delete such data.

How Your Personal Data is Collected

We may collect Personal Data about you from the following categories of sources:

    • When you provide such information directly to us.
    • When Personal Data about you is automatically collected in connection with use of our Services as referenced below.
      1. Usage Information. We collect information about your use of the Site. This may include the pages you visit, the links you hover over and click or tap on, and the items you purchase. We also collect data about your device such as IP address, mobile phone number, device identifiers, and data about the network, operating system, or software you use to connect to Face2Social’s products and services. We may also utilize third party services to collect usage information.

      3. Account Information. We collect information that you provide in creating an account at the Site. This may include information such as your name, email address, or phone number and payment data. We also collect passwords and similar security information used for authentication and account access.
      4. Search History. We retain a history of the searches you conduct on our Site.
      5. Submissions, Posts, and Uploads. We collect information from you when you provide, post, or upload it to Face2Social, such as when you fill out a form (e.g., a request to contact you) or respond to a survey.
  • Third Parties

    • Service Providers. We may use analytics service providers to analyze how you interact and engage with the Services, or third parties may help us provide you with customer support. We also receive information about you from some of our service providers who assist us with marketing or promotional services related to how you interact with the Site, applications, Services, advertisements or communications.
    • Social networks analyzed through the Services. If you provide your social network account credentials to us or otherwise sign in to the Services through a third-party site or service, some content and/or information in those accounts may be transmitted into your account with us.
  • Publicly Available Information

    • Public Internet Sources. We gather information that individuals or organizations have made publicly available on the internet, including professional websites, news articles, press releases, and public business listings. This may include professional achievements, business associations, and other publicly disclosed details.
    • Public Social Media Content. We may collect information that users have chosen to make public on social media platforms, professional networking sites, and other public forums. This includes public profiles, posts, and professional information that users have deliberately made available to the general public. Users who wish to limit our access to their information should review and adjust their privacy settings on these platforms.

How and Why We Use Your Personal Data

Under data protection law, we can only use your Personal Data if we have a proper reason for doing so, e.g.,:

  • To comply with our legal and regulatory obligations;
  • For the performance of our contract with you or to take steps at your request before entering into a contract;
  • For our legitimate interests or those of a third party; or
  • Where you have given consent.

A legitimate interest is when we have a business or commercial reason to use your information, so long as this is not overridden by your own rights and interests.

    • Monitoring and controlling system modifications to maintain security integrity;
    • Protecting commercially sensitive information through appropriate security controls.

    • Updating and enhancing customer records to ensure accuracy and completeness;
    • Managing customer information updates for existing services;
    • Maintaining historical records as required by law or regulation;
    • Verifying and validating the accuracy of customer information; and
    • Processing customer requests for record updates or modifications.

We will not collect additional categories of Personal Data or use the Personal Data we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Who We Share Your Personal Data With

We disclose your Personal Data to the categories of service providers and other parties listed in this section.

  • Service Providers
    • These are third parties acting on our behalf that help us provide and market our Services, including ad networks, marketing providers, hosting other technology and communications providers, data storage, analytics providers, and contract personnel.
  • Users of Services
    • We use Public Information we obtain ourselves or from third-party data sources to provide Services to our customers, so we may share your publicly-available social media information with other users of our Services directly or through our resellers or business partners. Social media users who do not want their data processed by Face2Social can make their account or posts private and, to the extent applicable, remove Face2Social and its representatives from their followers.
    • We do not verify and cannot guarantee the accuracy of Public Information.
    • Personal information, such as information that you provide to Face2Social or information about your use of Face2Social is not part of the Public Information available to other users through Face2Social or through our business partners or resellers.
  • Legal Obligations
    • We may share any Personal Data that we collect with relevant third parties in conjunction with any of the activities set forth under “Meeting Legal Requirements and Enforcing Legal Terms” in the “How and Why We Use Your Personal Data” section.
    • We may be required, upon receipt of a court order or equivalent, to release the information in civil or criminal litigation, or as otherwise required by law, to disclose information regarding a consumer to law enforcement agencies.     • Carrying out other legal obligations stated when collecting your Personal Data or as otherwise set forth in applicable data privacy laws, such as the California Consumer Privacy Act (the “CCPA”).
  • Business Transfers
    • All Personal Data may be transferred to a third party if we undergo a merger, acquisition, bankruptcy or other transaction in which that third party assumes control of our business (in whole or in part). Should any of these events occur, we will make reasonable efforts to notify you before your information becomes subject to different privacy and security policies and practices.
    • We do not send consumer information outside of the United States for any purpose other than to deliver a report to an end user. Of course, if information is sought from outside of the United States, the information is gathered in that country and then transmitted to us here in the United States where it is treated as any other consumer information.

Where Your Personal Data is Held

Information may be held at our offices and those of our service providers, third parties, representatives and agents as described above (see above: “Who We Share Your Personal Data With”).

How Long Your Personal Data Will Be Kept

We will keep your Personal Data while you have an account with us or we are providing the Services to you. Thereafter, we will keep your Personal Data for as long as is necessary:

  • To respond to any questions, complaints or claims made by you or on your behalf;
  • To show that we treated you fairly;
  • To keep records required by law.

We will not retain your Personal Data for longer than necessary to fulfill the purposes for which it was collected. Different retention periods apply for different types of Personal Data. For Biometric data we will destroy the data within three (3) years of receipt or when the purpose for collection has been satisfied.

Your Rights Under the CCPA

If you are a resident of California, you are entitled to certain rights under the CCPA regarding the collection, use, and storage of personal data.

Right to Deletion

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will: Delete your personal information from our records; and Direct any service providers to delete your personal information from their records.

You have the right to not be discriminated against by us because you exercised any of your rights under the CCPA. This means we cannot, among other things: Deny goods or services to you; Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties; Provide a different level or quality of goods or services to you; or Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services. Please note that we may charge a different price or rate or provide a different level or quality of our Services to you, if that difference is reasonably related to the value provided to our business by your personal information.

Illinois Residents

Face2Social does not offer any services to Illinois residents or for Illinois residents. Face2Social has implemented all possible technical measures to block all data that can be reasonably linked with the state of Illinois. Any data subject to whom the Illinois Biometric Data Privacy Act (“BIPA”) applies must not use this Site.

Use of cookies and similar technologies

Cookies are small text files placed on your computer or other device by websites that you visit. Cookies are widely used in order to make websites and other applications work, or work more efficiently, and help them remember certain information and recognize your internet browser. Cookies may last until you close your browser (“session” cookies) or over repeat visits (“persistent” cookies).

Use of Web Beacons and Other Technologies

Some of the Sites applications and electronic communications contain electronic tags known as web beacons, gifs or pixel tags, unique identifiers and similar technologies that help deliver cookies, measure online activity, provide more relevant advertising, or analyze the effectiveness of our promotional campaigns or other operations.

Keeping Your Personal Information Secure

We seek to protect your Personal Data from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of Personal Data and how we are processing that data. We store information in paper-based files or electronic records in secure databases in the U.S. (including trusted third-party storage providers). We take reasonable steps to protect your Personal Data from misuse, interference and loss and from unauthorized access, modification or disclosure. You should also help protect your data by appropriately selecting and protecting your password and/or other sign-on mechanism; limiting access to your computer or device and browser; and signing off after you have finished accessing your account. Although we work to protect the security of your account and other data that we hold in our records, please be aware that no method of transmitting data over the Internet or storing data is completely secure.

Face2Social maintains the following security measures among others to protect a consumer’s Personal Data:

  • Access to confidential consumer information is limited within Face2Social to those who have a need to know the information: obtaining and transmitting information on the consumer or those dealing with a consumer request for information or consumer disputes;
  • Access to Face2Social’s computer terminals, file cabinets, fax machines, trash bins, desktops, etc. are secure from unauthorized access. Information is stored on third party computers which meet or exceed these standards;
  • Face2Social maintains a secure network to safeguard consumer information from internal and external threats;
  • Any backup data is maintained in an encrypted form;
  • Access by users over the internet requires a confidential user name and alpha/numeric password;
  • Face2Social maintains records on each request for information and identifies each user who requested information on a consumer;
  • Employees are prohibited from “browsing” files or databases without a business justification;
  • Employees are not allowed to order reports on themselves, family, friends or associates without approval of management; and
  • Destruction of consumer information follows the federal regulatory requirements that the information be unreadable upon disposal.

We retain Personal Data about you for as long as you have an open account with us or as otherwise necessary to provide you with our Services or to fulfill the purposes outlined in this Privacy Policy. In some instances we retain Personal Data for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule or regulation. We may further retain information in an anonymous or aggregated form where that information could not be used by us or a third party to identify you personally.

Personal Data of Children

Our site is directed to people who are at least 18 years old. Face2Social does not knowingly collect Personal Data from anyone under the age of 18. If you are aware that Face2Social has collected Personal Data from someone under the age of 18, please alert Face2Social at privacy@face2social.com and the information will be removed from Face2Social’s systems as soon as is reasonably possible. This policy regarding collection of data from children exceeds the requirements of the Children’s Online Privacy Protection Act.

Face2Social does not knowingly aggregate or provide Public Information about people under the age of 18. Face2Social’s search may return Public Information about children between the ages of 13 and 18 because this Public Information originates from third-party social networking sites and websites that permit children who are 13 years and older to create public profiles. To remove any Face2Social listing, including a listing that contains information about a person under the age of 18, please use the delete my information tool.
